ARTICLE 1. DEFINITIONS

In these Terms and Conditions, the Parties agree to the following use and definition in relation to the terms reproduced in this article.

Whenever used in these Terms and Conditions, including the Article titles, the following terms, used with initial capital letters, will have the meanings established in this Article, without distinction as to whether they are used in the singular or plural:

"Subscription" means paid subscription to the Jaw Games Service under the stated terms and conditions.

"Application" means the application developed by Blacknut and provided in partnership with Jaw Games to access the Service.

"User Account" means a user's personal account to which personal information related to their use of the JAW GAMES Service is attached.

"Game" means a video game that a User can access through their Subscription.

"Player" means the natural person with a player profile created from of a User Account, within the limits established therein.

"Service" means the online Game Subscription service offered by Jaw Games, as defined in Article 3.

"Site" means the Jaw Games website, accessible at https://jaw.games/

"Terms and Conditions"means the following terms and conditions.

"User"means the natural person who has subscribed to Jaw Games.

ARTICLE 2. PURPOSE

The purpose of these Terms and Conditions is to define the Terms and Conditions applicable to user access to the Jaw Games Service.

These Terms and Conditions apply to the exclusion of all other terms and conditions unless expressly agreed otherwise in writing by Jaw Games. They are accessible at any time on the Website and are systematically communicated to the User upon request.

Any access to the JAW GAMES Service implies acceptance of these Terms and Conditions.

ARTICLE 3. JAW GAMES SERVICE

JAW GAMES is a game streaming service that provides the ability to browse, access, use and play streaming games cloud-based on demand, through compatible devices and in accordance with the duration and conditions of the Subscription selected by the User.

The main characteristics of the Service and Subscriptions are presented on the website. As part of the Service, the User has access to the following features:

• Creation of a User Account;
• Creation of multiple player profiles from the User Account, the maximum number of which is defined in the selected Subscription;
• Access to all Games available on the Website and Application;
• Connection to multiple compatible devices , whose number is defined in the selected Subscription;
• Parental Controls

It is the User's responsibility to take this into consideration before selecting a Subscription.

ARTICLE 4. USER ACCOUNT

Creating a Subscription requires the prior creation of a User Account using the information you provide to us through the Application or the Site. The User is objectively responsible for the confidentiality of their identification data and password, as well as other information pertinent to accessing the User Account and for the security of their equipment and system.

To create an account and sign the Jaw Games Service, you must be at least 18 years old or at least 16 years old and emancipated. It is the responsibility of those with parental authority to determine which service is, or is not, appropriate for their dependents and to take necessary precautions to restrict access to certain services and content. Use of the Jaw Games Service by a minor remains the responsibility of the parent (or guardian).

Once you are a Subscriber and comply with these Terms and Conditions, you and members of your family will be able to access the Jaw Games Service creating Player profiles, limited to the maximum number included in the selected Subscription. For this purpose, the Parental Control configuration is made available to the account holder to create a player profile adapted for minors. The User is responsible for the use of the Jaw Games Service by all Players and in particular by minors who may have access to their User Account.

ARTICLE 5. SUBSCRIPTION

The price, duration and conditions of the Subscription are presented on the Jaw Games home page. Your Subscription allows you to connect to the Service with your compatible devices, within the limits established by the Subscription you purchased. The technical requirements for accessing the Jaw Games Service are set out in article 9.

ARTICLE 6. PAYMENT AND INVOICE METHODS

The Subscription fee is charged according to the plan selected: Daily, Weekly or Monthly. The Daily and Weekly plans are prepaid and expire automatically at the end of the contracted period. To continue playing, the User must purchase a new plan, entering a valid payment method. Taxes, as well as any other fees related to your use of the Jaw Games Service, are calculated based on the information provided and the rate applicable at the time of billing.

The Monthly plan is billed on a recurring basis and is debited monthly on the first day of the month of your Subscription through the registered payment method. The billing date is automatically set at the time of purchase. Every month of Subscription started, excluding the free trial period, you will be charged. Taxes, as well as any other fees related to your use of the Jaw Games Service, are calculated based on the information you provide and the rate applicable at the time of monthly billing. You are responsible for any costs related to your Internet connection.

If payment fails for any reason, the Monthly Subscription will be immediately suspended. The User may reactivate their Subscription at any time by entering a new payment method. When you enter a new payment method, it will be transacted immediately and if successfully billed, your Subscription will be renewed for a new period of one month, renewable from month to month, unless canceled. The day of the month of this payment becomes the new billing date.

If you purchase a Subscription or a Free Trial for a Subscription, unless you cancel the service before the billing date, you understand that your Subscription will automatically be continued using the registered payment method.

Gift cards gift are valid for the duration indicated in the order confirmation of the purchase thereof, from the date of issue of the gift card, and are loaded with a subscription duration in accordance with the options chosen by the User or a third party when ordering the gift card on the website.

The User has the option, at any time during their Subscription, to enter another payment method in their User Account, under the conditions of article 6.1. above in order to extend the duration of your Subscription.

Unused gift cards whose expiration date has passed cannot be returned, exchanged or refunded.

However, it is specified that if the Subscription is carried out through a partner distribution platform, the Subscriber is invited to consult the terms and conditions of the distribution platform that apply to the retraction conditions

ARTICLE 7. CHANGES TO PLANS AND PRICES

Jaw Games may, from time to time, change the prices of Subscriptions, as well as modify or discontinue the plans offered.

Any price change will be communicated to the User in advance, with reasonable notice. Changes will take effect at the start of the next Subscription period, following the date of the price change. Subject to applicable law, by continuing to use the Jaw Games Service after the change comes into effect, you will have accepted the new price. If you do not agree to a price change, you may reject the price change by canceling the applicable Paid Subscription before the change takes effect.

Taxes are based on the rates applicable at the time of billing. These amounts may change over time based on local tax requirements in your country, state, territory, or even city. Any tax changes will be applied automatically based on the account information you provide.

ARTICLE 8. CANCELLATION

With the exception of Subscriptions for a prepaid period, such as Daily and Weekly Plans, your payment to Jaw Games will be automatically renews at the end of the applicable subscription period unless you cancel your Subscription before the end of the current subscription period.

If you subscribed directly through Jaw games, you may cancel your Subscription at any moment by logging into your User Account. Upon completion of the cancellation process, you will have access to the Service until the expiration date of the month of your current Subscription. You may re-register at any time under the terms and conditions set forth herein.

We do not provide refunds or credits for partial Subscription periods.

Jaw Games stores your game saves for the entire duration of your subscription. When canceling your contract, your game saves will be archived for a period of one year before being destroyed forever if you do not reactivate your account within that time.

ARTICLE 9. TECHNICAL AND GEOGRAPHICAL PREREQUISITES

The User agrees that the very nature of an online video game service such as the Jaw Games Service , requires its own technical environment. To access the service, the User will need to use a personal computer, a mobile device, a Smart TV or other device that meets the system and compatibility requirements that we have established in the following link:https://jaw.games/download/

We may add more compatible devices or change requirements from time to time, and in some cases, whether a device is (or continues to be) compatible may depend on software or systems provided or maintained by the device manufacturer or other third parties. Accordingly, devices that were once supported may no longer be supported in the future.

Additionally, in order to access the Jaw Games Service with a supported device, you must download the App and sign up for a Subscription. The Application is updated regularly. You agree to download updates regularly for the Service to function properly.

Streaming resolution and content quality, as well as Service latency, will depend on a number of factors, including the type of device on the which you are accessing the Service, your location, your network connection, your bandwidth and the status of your subscription. Your ability to access and use the Service may be interrupted if your connection does not meet minimum requirements or due to connectivity issues. If we detect that the Content we are transmitting to you may be interrupted or may not play correctly due to bandwidth restrictions or other factors, we may optimize the transmission quality in an effort to provide an uninterrupted experience. As such, Jaw Games cannot be held responsible for transmission difficulties or for any interference with the Internet network that affects the use of the Service. While we strive to provide you with a high-quality experience, Jaw Games makes no guarantees regarding streaming conditions, streaming quality, and accessibility of the Service.

You are solely responsible for any access, additional data or fees incurred by third parties (such as your Internet provider or mobile carrier) in connection with your access to and use of the Service.

Exceptionally, Jaw Games may suspend access to all or part of the Service if we determine that (a) your use of the Service (i) is related to a security concern, (ii) may adversely affect the Service or systems or one or more Games, (iii) may expose us, our affiliates or any third party to liability, or (iv) may be fraudulent; or (b) you are in breach of any of your obligations under these Terms and Conditions.

Jaw Games will use technologies to verify your geographic location. You may not use any technology or techniques to hide or disguise your location. Verification of a User's place of residence can be done using the payment information entered in the User Account or through any request for proof of residence made by JAW GAMES or even through the connectivity used by the user. If such verification cannot be carried out or if a User is no longer a resident of the countries specified in this document, Jaw Games reserves the right to suspend access to the Service.

The User acknowledges that the quality of the Service may be impacted by the Service connection methods chosen by the User and that the catalog of available Games may vary under the conditions indicated in Article 8.

ARTICLE 10. INTELLECTUAL PROPERTY

Jaw Games grants you, during the term of your Subscription and in the countries in which the Service is available, a license personal, non-exclusive and non-transferable limited to access to the Service to access and play the catalog of Games available under the terms established herein.

Any other use and in particular any public representation and/or reproduction and any exploitation outside of the family circle, for professional, commercial or promotional purposes of all or part of the Jaw Games Service, the Application and the Game(s), is prohibited without the express, written and prior authorization of Jaw Games.

In particular, the User is prohibited from modifying, decompiling, translating, adapting, distributing, transmitting, diverting or copying all or part of the Service, any of the Games and/or the Application and its constituent elements, in any way that be.

The User acknowledges that the Games and all their constituent elements, as well as the rights relating to the trademarks of their Publishers, are protected by intellectual property law under applicable regulations, the violation of which is subject to entail the civil liability of its author. You further acknowledge that due to the existence of intellectual property rights in the Games, certain Games available on the Jaw Games Service in your country of Subscription may not be available depending on the authorizations granted to JAW GAMES by its assigns. You represent and warrant that you own or have all necessary rights in the content so posted to grant this license.

ARTICLE 13. SAFETY

Some individuals may experience dizziness, convulsions, and/or fainting when exposed to flashing lights or other repetitive light patterns, which may occur when playing video games. If you or any member of your household has a family history of epilepsy or any of these conditions, please consult a physician before using the Service. If you or a member of your family experience any of these symptoms while using the Service, stop using the Service and seek medical attention immediately. Children and teenagers may be more prone to these conditions than adults. Adults should monitor their children closely for these symptoms and should encourage them to take frequent breaks when using the Service, to use it in a well-lit room, and to sit a reasonable distance from the screen.

ARTICLE 14. OTHERS

If, for any reason, all or part of the above provisions are revoked, the remaining provisions will, however, remain in full force and effect. If any of the provisions of these Terms and Conditions is invalid in relation to a legislative or regulatory provision in force and/or a judicial decision with the force of res judicata, it will be considered non-existent, but will not affect the validity of the other provisions, which will remain fully applicable .

Jaw Games reserves the right to assign, transfer or transmit to third parties, in any form, all or part of the rights and obligations described herein or substitute a third party for the fulfillment of all or part of the rights and obligations described herein, without such assignment or transmission resulting in any diminution of your rights.
